Independent Sales Representative (Subcontractor) Job Description We are seeking a commission-only independent sales contractor to promote and sell our food products to foodservice customers, including restaurants, hotels, schools, hospitals, cafes, caterers, and other institutional buyers. This is a 1099 independent contractor position with no base salary. You will operate in an assigned territory (to be mutually agreed upon) on a non-exclusive basis, with flexibility to manage your own schedule while driving new business growth. What You'll Do • Prospect and develop new foodservice accounts through cold calling, networking, product demonstrations, and relationship-building. • Present and promote our product line to chefs, purchasing managers, and decision-makers. • Secure orders, negotiate pricing within approved guidelines, and follow up to ensure customer satisfaction and repeat business. • Maintain accurate records of sales activities, customer interactions, and pipeline using provided tools (e.g., CRM if applicable). • Attend trade shows, food expos, or industry events as needed to generate leads. • Provide market feedback on competitor activity, customer needs, and product opportunities. • Collaborate with our team on promotions, samples, and account support. Qualifications • Proven track record in foodservice sales (2+ years preferred), ideally with food products, ingredients, or related lines. • Established network of contacts in the foodservice industry within the assigned territory is a strong advantage. • Strong understanding of foodservice operations, menu development, and distribution channels. • Excellent communication, negotiation, and presentation skills. • Self-motivated, results-oriented, and able to work independently with minimal supervision. • Reliable transportation and willingness to travel within the territory. • Familiarity with CRM tools and basic reporting is a plus. • Strong interpersonal and negotiation skills with the ability to build rapport quickly. • Valid driver’s license and reliable transportation (travel to client locations required). • Flexible schedule with availability to work evenings or weekends as needed. Preferred Skills • Knowledge of food products commonly used in the restaurant industry. • Experience with additional CRM or sales tools (e.g., Salesforce, HubSpot). • Familiarity with Microsoft Excel for data analysis and reporting. Compensation Structure (Commission-Only) • Base Commission: 10% of net invoiced sales (invoiced amount after discounts, before taxes/shipping). • Quarterly Performance Bonus: Additional 2% commission on all net invoiced sales exceeding $75,000 in a calendar quarter. • Commissions are paid monthly, within 45 days after customer payment is received by the company (standard to account for credits/returns). • No reimbursement for expenses (travel, samples, etc.)—contractor is responsible for all costs. Contract Terms • Status: Independent contractor (1099)—no employee benefits, taxes withheld, or employment relationship created. • Territory: Assigned geographic area (details to be specified in agreement); non-exclusive. • Term: Initial one-year term, automatically renewing unless terminated with written notice. • Ongoing Commissions on Repeat Orders: The contractor will receive full commission (10%, plus any applicable quarterly bonus) on all repeat orders from accounts secured by the contractor for a maximum of 2 years from the date of the account's first order. After this 2-year period, the account will be reclassified as a house account, and commissions on that account will cease. • Post-Termination Commissions: • * Trailing commissions for 3 months following termination on net invoiced sales from accounts secured by the contractor (including repeat orders placed within those 3 months). • Ongoing commissions on repeat orders will continue to be paid post-termination only up to the earlier of (i) 2 years from the date of the account's first order or (ii) 3 months post-termination. • Transition to Employment: If the contractor becomes an employee of the company, all accounts secured by the contractor will be transferred to that employee, and ongoing compensation for those accounts will be governed by the employment agreement (commissions on existing accounts will cease under this contractor agreement). • Full details, including house accounts, splits on shared deals, confidentiality, and non-compete provisions, will be outlined in the formal Independent Sales Representative Agreement.
